Privacy Statement

 

The Wellspring of Life Refuge respect your right to privacy and comply with our obligations under GDPR. The purpose of stating our web site privacy policy is to outline how we deal with any personal data provided to us while visiting this web site. If you are not happy with any element of the policy set out below you should refrain from use of this web site.

 

TWSOL GDPR Policy

 

This Policy sets out the following:

 

What personal data we collect and process about you in connection with your relationship with us as a guest and through your use of our website, mobile applications and online services; Where we obtain the data from; What we do with that data; How we store the data; Who we transfer/disclose that data to; How we deal with your data protection rights; And how we comply with the data protection rules.

 

All personal data is collected and processed in accordance with Irish and EU data protection laws. ​

 

1. Data Controller:

The Well Spring of Life Refuge referred to as TWSOL in this policy is the “data controller” of personal information collected and used about TWSOL guests for the purposes of The Irish Data Protection Act 2018. TWSOL is a charitable company registered in Ireland: Company No, 636772, registered address 42A Pearse St., Dublin 1. Charity No. Occasionally we may engage third parties to provide services to you or your children. The third party will be the “data controller” of your personal data in respect of the service they are providing. You should access the privacy policies/statements of those providers directly. ​

 

2. Personal Data we collect:

Personal data means any information relating to you or your children which allows us to identify you, such as your name, contact details, and any information about your access and use of our website. We may collect personal data from you when you access our website or when you contact us.

 

Specifically, we may collect the following categories of information:

 

  • Name, home address, e-mail address, telephone number, passport or other recognized personal ID card numbers and details, nationality, date of birth, gender.
     

  • Special category information - Medical conditions for you and/or your children where special medical requirements and/or dietary requirements need to be disclosed.
     

  • Information about your use of our website.
     

  • The communications you exchange with us or direct to us via letters, emails, chat service, calls, and social media.
     

  • Location, including real-time geographic location of your computer or device through GPS, Bluetooth, and your IP Address, along with crowd-sourced Wi-Fi hotspot and cell tower locations, if you use location-based features and turn on the Location Services settings on your device and computer.

 

3. Special Categories of personal data:

Personal details about your physical or mental health, alleged commission or conviction of criminal offences are considered “special categories of personal data “under the GDPR and applicable data protection laws. We will only process such data where you have given your explicit consent, for example where you disclose this information to us and where we need to disclose it to third parties to protect the life of you or your children or those of other people. Where you or your children have specific medical conditions, you need to inform us of this on arrival at our facility and in some instances provide us with a medical certificate. This is for your health & safety and/or that of your children.

 

4. For what purpose do we use your personal Data, and for how long:
Your data may be used for the following purposes:

  1. We may use your data for administrative or legal purposes; for statistical analysis; systems testing, guest surveys, maintenance and development, or in order to deal with a dispute or claim. Note that we may perform data profiling based on the data we collect from you for statistical analysis purposes. By providing any personal data you explicitly agree that we may use it to perform profiling activities in accordance with this Privacy Policy;

  2. We may be obliged to provide your information to protect you and your children’s security, health, for crime prevention/detection; we may be required to pass your information to government authorities or enforcement bodies for compliance with legal requirements. See also Section below on your data protection rights. GDPR and applicable data protection laws allow us to process your personal data where we have the legal basis to do so. The legal basis will depend on the reasons we collect and need to use your personal
    data. In most cases we will need to process your personal data so you and your children can access and use our services. ​


We may also process your personal data for one or more of the following:

  • To comply with a legal obligation;

  • You have consented to us using your personal data;

  • To protect your sensitive personal information or that of your children (e.g. in case of a medical emergency); ​


Only children aged 16 or over can provide their own consent. For children under this age, consent of the children’s’ parents or legal guardians is required. We will not retain your data for longer than is necessary to fulfil the purpose it is being processed for. To determine the appropriate retention period, we consider the amount, nature and sensitivity of the personal data, the purposes for which we process it and whether we can achieve those purposes through other means. ​

We must also consider periods for which we might need to retain personal data in order to meet our legal obligations or to deal with complaints, queries and to protect our legal rights in the event of a claim being made. When we no longer need your personal data, we will securely delete or destroy it. We will also consider if and how we can minimise over time the personal data that we use, and if we can anonymise your personal data so that it can no longer be associated with you or identify you, in which case we may use that information without further notice to you. We would do this mainly to track the use of and monitoring of feedback both positive and negative.

 

5. Securing your personal data:

We follow strict security procedures in the storage and disclosure of your personal data, and to protect it against accidental loss, destruction or damage. The data you provide to us is protected using SSL (Secure Socket Layer) technology. SSL is the industry standard method of encrypting personal information so that they can be securely transferred over the Internet. For people making donations on our website, all payment details are transmitted over SSL across dedicated network infrastructure (Multiprotocol Label Switching-MPLS) and stored in compliance with Payment Card Industry Data Security Standards (PCI DSS). We may disclose your information to trusted third parties for the purposes set out in this Privacy Policy. We require all third parties to have appropriate technical and operational security measures in place to protect your personal data, in line with Irish and EU law on data protection rules. ​

 

6. International Data Transfer:

While this would be rare, TWSOL requires all services providers to process your information in a secure manner and in accordance with Irish and EU law on data protection. We utilise standard means under EU law to legitimise data transfers outside the EEA.

 

7. TWSOL Data:

All data collected upon registration in TWSOL will be processed in line with this Privacy Policy. When our use of your personal data, and that of your children, is based on your consent, you have the option to withdraw your consent to our processing and delete your personal data, and that of your children at any time. You can do this by submitting your request in writing. (see Section on Your data protection rights). Please note that general retention periods apply to any personal data we collect to enter into a contract with you or to perform that contract or because we have a legal obligation to process it. ​

 

8. Cookies and site visits:

Our site uses cookies to enable us to improve our service to you and may include cookies of our social partners that are being placed on your machine when visiting our website or App. Please visit our partners’ websites for information on their privacy and cookie policy. Cookies are small text files that are transferred to your computer's hard drive through your web browser to enable us to recognise your browser and help us to track visitors to our site; thus, enabling us to understand your needs better. A cookie contains your contact information and information to allow us to identify your computer when you travel around our site for the purpose of helping you accomplish your reservation. Most Web browsers automatically accept cookies, but, if you wish, you can change these browser settings by accepting, rejecting and deleting cookies. 9. Data Protection Officer:

We have appointed a Data Protection Officer (“DPO”) to oversee compliance with this policy. In addition, you have the right to make a complaint at any time to a supervisory authority. The Irish Data Protection Commissioner is the lead data protection supervisory authority of an Irish data controller.

 

10. Your Data Protection Rights:

 

Under GDPR and other data protection laws your data rights in relation to your personal information are as follows:
 

  • Request for erasure of your personal information (right to be forgotten). You may ask us to delete or remove personal data in relation to you and your children, where we have no legal basis to continue to process it. We will retain the personal data that relates to you and your children in order to defend or pursue our legal rights and meet our obligations towards regulatory or governmental authorities. You can request erasure in writing through office@thewellspringoflife.ie Please note we will make every effort to erase data where this right has been exercised by you and we no longer have a legal basis for processing same but some personal data sets are unsuitable to edit or remove (e.g. server backup or microfiche).

  • Request information. Sections 2,3 and 4 above sets out what personal data we collect and sets out the reasons we collect it.
     

  • Request access to the personal data we hold about you. You will need to provide a copy of your photo ID, either passport or national ID, when making your request so we can verify your identity. We may not be able to provide you access to the data when it involves information relating to others who have not consented to the disclosure of their information.
     

  • Request correction of the personal information that we hold about you or your children under 16. in writing through office@thewellspringoflife.ie
     

  • Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you and your children, but only in limited circumstances, which you must set out in in writing through office@thewellspringoflife.ie
     

  • Request portability of your personal information in an electronic and structured form to you or to another party (commonly known as a right to “data portability”). This enables you to take your data from us in an electronically useable format and to be able to transfer your data to another party in an electronically useable format.
     

  • Withdraw consent. In the limited circumstances where you may have provided your consent to the collection, processing and transfer of your personal information for a specific purpose, you have the right to withdraw your consent for that specific processing at any time, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another legitimate basis for doing so in law.
     

  • Third parties. If you are applying on behalf of another person then we require a signed letter of authority from the data subject. If you are applying as a parent/guardian of children then we require the signed letter of authority. ​

 

This policy should help you to understand how we use your personal information, it explains in detail the types of personal information we collect, what we use it for and who we may share it with. These requests cannot be actioned through email, as we need to verify your identity before we can act on your request. This is another example of how we protect your personal information. ​

 

TWSOL does not normally charge you a fee to access or amend your personal information. However, we reserve the right to charge a reasonable fee or refuse to comply with any excessive or unfounded claims for access. ​

 

11. Changes to our GDPR Policy:

Our GDPR Policy may change in line with any regulatory changes or any changes within TWSOL any such details will be advised by notice on our website www.thewellspringoflife.ie â€‹
